Photographer is suing Getty Images for $1 Billion.

Fair Use under scrutiny

Last December Pythom/Explorersweb reported about an image of peak Chapayev submitted to Shutterstock by Father Alexander, climber and spiritual adviser of Kazakh mountaineers.

The American stock photography provider licenses images on behalf of photographers and at one point F Alexander got $62,50 for his pic.

Turned out the image was used in billboards to advertise Everest in the blockbuster 3D IMAX movie. On top of showing the wrong peak, the story also raised questions about “fair use” of stock images.

The general issue of fair use will now be tried in a court, as one photographer is suing Getty Images for $1 Billion.
